Teacher Prohibited from Wearing Cross Necklace

Country: Germany

Date of incident: April 11, 2017

School officials ordered a Protestant Christian teacher in Berlin to remove her cross necklace when she is in the classroom. Berlin's neutrality law prohibits teachers and civil servants from wearing religious symbols and clothing in public.

The neutrality law had generally applied to Muslim women wearing hijabs or headscarves. In 2015 the German Constitutional Court found general headscarf bans unconstitutional. The president of the regional Protestant churches called Berlin's neutrality law unconstitutional, as well. In March 2017, the European Court of Justice ruled that employers could prohibit workers from wearing religious symbols at work if there was a good reason.  Sources: Der Tagesspiegel and The Local
